The Chief Justice and President of the Republic of Kenya, published a new Court Fees Assessment Schedule vide Gazette Notice No. 6830 (link).

The notice indicates that the said schedule is to apply to the lodging or filing of respective documents in the relevant proceedings before specified Courts and tribunals which are as follows:

  1. High Court
  2. Environment and Land Courts (ELC)
  3. Magistrates Court
  4. Kadhis Court,
  5. Tribunals save for Political Parties Dispute Tribunal, Transport Licensing Appeals Board, Industrial Property Tribunal, Energy Tribunal, Competition Tribunal, Rent Restriction Tribunal, Business Premises Rent Tribunal and the Co-operative Tribunal.

The Gazette Notice No. 6830 took effect from the 1st of July, 2021 and also revoked Gazette Notice No. 10181 of 2020 which was issued earlier.

We therefore note to advice our esteemed clients that fees payable shall increase and we wish to note that the same shall be duly communicated on a case-by-case basis dependent on the services rendered.
